Welcome to Flance. These Terms and Conditions (“Terms”) govern your access to and use of the Flance platform, including our website, applications, and services (collectively, the “Platform”). By accessing or using Flance, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Platform.

1. About Flance

Flance is an online freelancer marketplace that connects Freelancers and Employers for the purpose of offering and obtaining services through fixed-price and hourly-based projects.
Flance provides tools such as project listings, messaging, escrow, wallet management, and dispute resolution to facilitate transactions but is not a party to any agreement between Freelancers and Employers.

2. Eligibility

To use Flance, you must:

  • Be at least 18 years of age

  • Have the legal capacity to enter into binding contracts

  • Provide accurate, complete, and up-to-date registration information

Flance reserves the right to suspend or terminate accounts that do not meet these requirements.

3. User Accounts

  • Users must register an account to access core features of the Platform

  • You are responsible for maintaining the confidentiality of your login credentials

  • Any activity performed through your account is your responsibility

  • Flance is not liable for losses caused by unauthorized account access due to user negligence

4. Role of Flance

Flance acts solely as a technology platform and intermediary:

  • We do not employ freelancers

  • We do not guarantee project completion or payment

  • We do not supervise or control freelancers’ work

All agreements, communications, and obligations are solely between Freelancers and Employers.

5. Projects & Payments

5.1 Project Types

  • Fixed Budget Projects: Payment is agreed upon before work begins

  • Hourly Projects: Payment is calculated based on tracked or reported hours

5.2 Escrow System

  • For fixed-price projects, Employers must deposit funds into escrow before work starts

  • Funds are released to the Freelancer only after milestone or project approval

  • Escrow protects both parties by ensuring payment security

5.3 Wallet System

  • Each user has a Flance Wallet to manage balances, earnings, and withdrawals

  • Wallet funds can be used for payments, withdrawals, or platform fees

  • Withdrawal methods and processing times may vary

6. Fees & Charges

  • Flance may charge service fees to Freelancers, Employers, or both

  • Fees may vary depending on project type or payment method

  • All applicable fees will be clearly displayed before confirmation

Flance reserves the right to modify fees with prior notice.

7. Dispute Resolution

  • If a disagreement arises, users are encouraged to resolve it through mutual communication

  • If unresolved, either party may raise a formal dispute via the Platform

  • Flance will review evidence provided by both parties and make a final decision

  • Flance’s decision is binding and based on fairness and platform policies

8. Prohibited Activities

Users must not:

  • Post false, misleading, or fraudulent information

  • Circumvent escrow or payment systems

  • Engage in harassment, abuse, or illegal activities

  • Violate intellectual property rights

  • Attempt to manipulate ratings, reviews, or disputes

Violation may result in account suspension or permanent termination.

9. Intellectual Property

  • Users retain ownership of content they upload

  • By posting content, you grant Flance a non-exclusive license to use it for platform operation

  • All Flance branding, software, and design are the property of Flance

10. Termination

Flance may suspend or terminate any account:

  • For violation of these Terms

  • For fraudulent or harmful activity

  • At its sole discretion, with or without notice

Users may also deactivate their accounts at any time.

11. Limitation of Liability

Flance is not liable for:

  • Project outcomes or work quality

  • Losses arising from disputes between users

  • Delays, interruptions, or data loss

Use of the Platform is at your own risk.

12. Indemnification

You agree to indemnify and hold Flance harmless from any claims, damages, or expenses arising from:

  • Your use of the Platform

  • Your breach of these Terms

  • Your interactions with other users

13. Modifications to Terms

Flance may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

14. Governing Law
